1. Acceptance of Terms

By accessing or using Fanbuzz ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site. These terms apply to all users of the Platform, including fans and celebrities.

2. Description of Service

Fanbuzz is an online marketplace that connects fans with celebrities, athletes, influencers, and public figures ("Talent") for the purpose of booking personalised video messages. Fans can browse Talent profiles, submit booking requests with personalised instructions, and receive custom video content.

Fanbuzz acts solely as an intermediary platform facilitating these transactions. We do not guarantee the availability of any specific Talent, nor do we guarantee specific content or quality beyond what is described in these Terms.

3. User Accounts

Fanbuzz offers two types of accounts:

• Fan accounts — created by individuals who wish to book personalised video messages from Talent on the Platform.
• Celebrity accounts — created for verified Talent who wish to offer personalised video services through the Platform.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account and keep it up to date. You must be at least 18 years old to create an account.

4. Booking and Payment

When a fan submits a booking request, they agree to pay the listed price for the video as displayed on the Talent's profile page. Payments are processed securely through Razorpay. By completing a booking, you authorise Fanbuzz to charge the applicable amount.

Once a booking is confirmed and payment is received, the Talent is expected to record and deliver the personalised video within 7 calendar days. Delivery timelines are indicative and may vary in exceptional circumstances.

Fanbuzz charges a platform commission on each completed booking. This commission is deducted from the amount payable to the Talent and is non-negotiable. The commission rate is communicated to Talent separately during onboarding.

5. Cancellation and Refunds

Fans may request a cancellation before a Talent has begun recording their video. Once a video has been recorded and uploaded, no refunds will be issued regardless of satisfaction with the content, provided the Talent has made a good-faith effort to follow the booking instructions.

If a Talent is unable to fulfil a booking within the specified timeframe, Fanbuzz reserves the right to issue a full refund to the fan at its sole discretion. Fanbuzz is not liable for any consequential damages arising from delayed or unfulfilled bookings.

6. Prohibited Content

Users may not submit booking requests or upload any content that:

• Is sexually explicit, obscene, or pornographic
• Is hateful, threatening, or harassing towards any individual or group
• Promotes or glorifies violence, terrorism, or illegal activity
• Infringes upon the intellectual property, privacy, or publicity rights of any third party
• Contains false, misleading, or defamatory statements
• Violates any applicable local, national, or international law or regulation

Fanbuzz reserves the right to reject, remove, or cancel any booking or content that violates these guidelines and to suspend or terminate the accounts of users who do so.

7. Intellectual Property

All videos created through the Platform are intended for the personal, non-commercial use of the fan who commissioned them. Fans may share videos on personal social media accounts provided they do not claim ownership or commercialise the content.

Talent retains all rights to their name, likeness, and performance. Fanbuzz retains all rights to its Platform, branding, and technology. Unauthorised reproduction, redistribution, or commercial use of any content on the Platform is strictly prohibited.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Fanbuzz, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, goodwill, or other intangible losses.

Fanbuzz's total liability to any user for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount paid by that user in the 12 months preceding the claim.
